Terms and Conditions

1. Definition

(a) “Applicant” means persons who seek to register themselves for the “Elephant Decoder Hackathon” as an individual or as a team.
(b) “Elephant Decoder Hackathon” means the innovative technology Competition organized by Mobitel together with the guidance of Department of Wildlife Conservation to provide a technological solution to the ever increasing human-elephant conflict arising due to gradual decrease in the areas dedicated for elephant habitat, by engaging the community to bring forward the Elephant Decoder Hackathon, by way of gathering most optimal and practical solutions from interested citizens who wish to contribute their invaluable technological knowledge/ideas to innovate a solution in order to implement an early warning system for detecting elephants in pre-defined areas.

2. Eligibility:

2.1 The Elephant Decoder Hackathon is for individuals or team of individuals submit their ideas/solutions online through the submission form available in the website https://sltmobitel-elephant-decoder.com during the specified time period.
2.2 The applicant shall ensure that all relevant fields in the submission form is duly completed with true and accurate information of the applicant consisting of an individual or a team of individuals.

3. Applicant’s Representations and Rights to Ideas:

3.1 By submitting an idea/Solution, the applicant represents and warrants that the idea/solution submitted for the Elephant Decoder Hackathon (i) does not violate applicable local and foreign laws and regulations (including without limitation the laws of Sri Lanka); (ii) does not infringe the intellectual property rights of any third party and (iii) does not infringe the confidential information of any third party or any other rights of any third party.
3.2 The Applicant shall accept and acknowledge that in the event the Applicant’s solution/proposal submitted to the Elephant Decoder Hackathon is selected for the implementation by the Government of Sri Lanka or any authorized agency on behalf of the Government upon successful completion of the Proof of Concept (POC), the Applicant shall be required enter into a separate agreement with the Government of Sri Lanka or its agent for implementation. The terms of such agreement between the Applicant and the Government of Sri Lanka (or its agent) is separate and shall be independent of the terms and conditions of the Elephant Decoder Hackathon. Applicant shall not be entitled to any commercial benefit or any other form of compensation from Mobitel on the basis of submitting a proposal for the Elephant Decoder Hackathon.

4. Selection of Ideas - Elephant Decoder Hackathon:

i) Mentors/Judges (herein after referred to as “selection panel”) shall be appointed by Mobitel at its discretion considering the expertise required, including but not limited to appropriate policy making government officers, hardware experts in the industry, etc.
ii) The selection panel, taking into account the selection criteria, will evaluate the ideas/solutions submitted by Applicants
iii) A pre-defined number of ideas/solutions shall be shortlisted by the selection panel as the eligible solutions to enter in to Phase 2.
iv) Due to the prevailing pandemic situation in the country, it is expected to host the Elephant Decoder Hackathon virtually via an online platform. If any decision is taken to host the hackathon in-person, Mobitel will inform the eligible applicants in advance to avoid any inconvenience.
v) Each Applicant selected for Phase 2 shall be entitled to an online private session (or if time permits an in-person evaluation) with the selection panel and the ideas/solutions shall be further evaluated and refined utilizing the expertise of the selection panel.
vi) Each short listed idea will then be required to build a prototype to assess the feasibility of each proposed solution.
vii) As per the performance and feasibility level of the solution prototype the most optimal three solutions (if any) shall be selected by the selection panel and it shall be announced at the end of the evaluation.
viii) The selection panel’s decision shall be final and the most optimal three solutions (if any) shall be awarded with cash prizes as provided below.
ix) Depending on the solution and its prototype’s viability and the decision of the selection panel, and subject to the consent and collaboration of Department of Wildlife conservation or an authorized agency on behalf of the government, there is an opportunity for the most optimal solution to be proceed with a Proof of Concept (POC) with relevant authorities. In any event, such POC will be carried out as a separate engagement between the Government and the selected Applicant governed by a separate agreement which is not within the scope of these terms and condition.

5. Prizes:

Mobitel at its sole discretion will award the following prizes to such Applicants who submit the most optimal three solutions (if any) in the opinion of the selection panel and Mobitel. Mobitel reserves the right not to award any of the below mentioned prizes, if the ideas/solutions are deemed unsatisfactory.

5.1 Marking Criteria:

Selection panel will conduct a 360-degree evaluation on many aspects of the idea/solution includingbut not limited to

  • Relevance to the purpose
  • Innovativeness/ Creativity/Originality
  • Social impact/Applicability/Relevance
  • User Experience
  • Technical and implementing feasibility/ Sustainability
  • Cost effectiveness
6. Confidentiality:

6.1 The Applicant acknowledges that in the course of the Elephant Decoder Hackathon the Applicant may have access to Confidential Information including, but not limited to, in respect of the Elephant Decoder Hackathon, Mobitel (or any of its holding, subsidiary or affiliate Company) or Elephant Decoder Hackathon submissions of other Applicants. The Applicant shall not either during the Elephant Decoder Hackathon or at any time after use any Confidential Information or make or use any copies of Confidential Information or disclose any Confidential Information to any person, entity or other organisation whatsoever.
6.2 The Applicant hereby authorize and consent Mobitel to use the Applicant’s personal data for the purposes of conducting the Elephant Decoder Hackathon. The Applicant’s photos, videos and images may be used by Mobitel in advertisements and promotions relating to the Elephant Decoder Hackathon and the applicant grants Mobitel the permission to have the Applicant’s images, photos, videos displayed in Mobitel advertisements and promotions relating to the Elephant Decoder Hackathon if required.

7. The Applicant agrees that it shall not do anything which would bring Mobitel or any of its holding, subsidiary or affiliate Company into disrepute or affect the reputation and/or materially adverse the interest of Mobitel or of its holding, subsidiary or affiliate Company.
8. Mobitel has initiated the Elephant Decoder Hackathon in good faith but, to the fullest extent permitted by law, accepts no responsibility for and will not be liable for any claims, costs, losses, damages, expenses or liabilities, of any kind (including without limitation direct, indirect, consequential, incidental or punitive damages) arising out of or in connection with the Elephant Decoder Hackathon and/or Prizes (whether individually or collectively). The Applicant agrees to indemnify Mobitel against all costs, losses, damages, expenses and liabilities (including for loss of reputation and goodwill) suffered by Mobitel arising as a result of a breach by the Applicant of the obligations under these Terms and Conditions or in any way in connection with the Applicant’s failure to follow reasonable instructions provided by Mobitel with regard to the Elephant Decoder Hackathon.

It is a condition of entry to the Elephant Decoder Hackathon that these Terms and Conditions are accepted and that the Applicant agrees to abide by these Terms and Conditions. Breach of any of the Terms and Conditions herein may result in the Applicant being disqualified from the Elephant Decoder Hackathon and any future competition organized by Mobitel
